You're quite right. When drafting estate planning / succession documents, we're very mindful of avoiding conflicts and potential conflicts of interest. It is also important to structure the documents and plans to avoid any potential conflict within a family or business. The potential for conflicts can be avoided by appointing a committee of trustees, an independent and impartial trustee or a professional trustee company should the need arise. There is no hard and fast rule so each matter needs to be dealt with based on its individual circumstances.

Are there any special considerations people must watch out for between guardians and trusts/testamentary trusts?
I foresee that complications may arise due to conflicts between them and conflicts of interest if the same person has control.
